Pursuant to Section 166.0451 of the Florida Statutes, the Town adopted the following resolution addressing Town-owned properties:

RESOLUTION 2023-28 

A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LONGBOAT KEY, FLORIDA, APPROVING AN INVENTORY LIST OF TOWN OWNED PROPERTIES PURSUANT TO SECTION 166.0451, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING AN EFFECTIVE DATE

WHEREAS, Section 166.0451, Florida Statutes requires that by October 1, 2023, and every 3 years thereafter, municipalities in the State of Florida prepare an inventory list of all real property within its jurisdiction to which the municipality holds fee simple title that is appropriate for use as affordable housing; and

WHEREAS, the inventory list must include the address and legal description of the property and specify whether the property is vacant or improved; and

WHEREAS, the Town Commission must review the inventory list at a public hearing, and revise the inventory list, if necessary; and

WHEREAS, following the public hearing, the Town Commission must pass a Resolution that includes the inventory list of the property; and

WHEREAS, Staff has reviewed the inventory of Town owned property, and has determined that the Town does not own any property that is appropriate for use as affordable housing; and

WHEREAS, pursuant to Town Staff's review of the inventory of Town owned property, the Town Commission accepts Staff's review, and hereby finds that the adoption of this Resolution is in conformance with the requirements of Section 166.0451, Florida Statutes.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF LONGBOAT KEY THAT:

Section 1.   Recitals. The above Whereas clauses are hereby incorporated, ratified, and confirmed as true and correct.

Section 2.   The Inventory List of Town owned property that is appropriate for use as affordable housing is hereby passed pursuant to Section 166.0451:

INVENTORY LIST

No Town owned property is appropriate for use as affordable housing.

SECTION 4.    If any section, subsection, sentence, clause or provision of this Resolution is held invalid, the remainder of the Resolution shall not be affected.

SECTION 5.    All Resolutions or parts of Resolutions in conflict herewith shall be and the same are hereby repealed.

Section 4.    This Resolution shall become effective immediately upon adoption.
