Ordinance 2020-09 - Resident Only Parking
The Town Commission finds and declares that it is in the best interest of the Town to control vehicular parking in the Longbeach Village residential neighborhood and limit parking via permit parking regulations to:
- Reduce hazardous traffic conditions resulting from the use of streets located within the Longbeach Village neighborhood for the parking of vehicles by persons seeking parking for commercial or public uses
- Protect the Longbeach Village neighborhood residents from excessive noise
- Protect the Longbeach Village neighborhood residents from unreasonable burdens in gaining access to their residences and preserve the character of the neighborhood;
- Promote efficiency in the maintenance of the public streets in a clean and safe condition;
- Preserve the value of the property;
- Preserve the safety of children and other pedestrians: and
- Promote traffic safety, clean air and comfort, health, convenience and welfare of the Town' s inhabitants
The following words, terms, and phrases, when used in this Schedule, shall have the meanings ascribed to them in this Schedule, except where the context clearly indicates a different meaning:
“Guest.” A person who is visiting a Resident.
“Guest Parking Permit.” A reusable permit, valid during a Program Year, issued to residents, for their guests to park on applicable public rights-of-way within the Resident-Only Parking Permit area.
“Program Year.” The time beginning January 1 and ending December 31 of that year.
“Resident.” A person who lawfully resides within the Resident-Only Parking Permit area, and meets the requirements of Subsection (D).
“Resident-Only Parking Permit area.” As defined in Subsection (C).
“Resident Parking Permit.” A permit, valid during a Program Year, issued to a resident for parking on applicable public rights-of-way within the Resident-Only Parking Permit area.
“Service Vehicle.” A motor vehicle with a business sign or logo owned and operated by a person, firm, or corporation actively engaged in a service or business activity at the home of a Resident within the Resident-Only Parking Permit area.
The Resident-Only Parking Permit area shall be comprised of all public rights-of-way within the Longbeach Village neighborhood area, where parking is otherwise allowed, beginning east of Palm Drive, with the exception of the portions of the south side of Broadway Street and the east side of Lois Avenue immediately abutting the commercially zoned properties as depicted on the official Zoning Map book. Note: Off-street parking spaces, including those provided by the Town to the public, for example, adjacent to the Town Dock and Pier, are not subject to Resident-Only Parking Permit Area provisions. A map of the Resident-Only Parking Permit Area is provided at the bottom of this page.
Parking Permits shall be issued by the Town to resident owners or tenants of residential properties located within the Resident-Only Parking Permit area as follows:
- The Resident Parking Permit application shall contain:
- The name and mailing address of the applicant; or
- The name and mailing address of the owner of the property and the applicant, if the applicant is not the owner; and
- A valid Driver’s License or I.D. with photo; and
- (i) The current motor vehicle registration for the intended vehicle for which the Resident Parking Permit is being sought; or (ii) if the vehicle is registered at an address other than the Resident Only Parking Permit area residence, or if the name on the vehicle registration is different from the applicant’s, then such other evidence as may be deemed acceptable to the Town Manager or designee showing that the applicant resides within the Resident-Only Parking Permit area and has entitlement to operate the subject vehicle (including, but not limited to, military identification, passport or other state-issued photo ID, utility bill, lease agreement or other location specific documentation).
- The Guest Parking Permit application shall contain:
- Proof of a current Resident Parking Permit.
- The Town may issue Resident or Guest Parking Permits to qualified applicants upon the payment of the required fee to assist in recovering the costs related to the administration and operation of the Resident-Only Parking Permit program. Guest Parking Permits shall not be issued unless a Resident Parking Permit has also been purchased. A schedule of fees for the purchase of parking permits shall be adopted by resolution.
- Two Resident Parking Permits may be issued per property or dwelling unit per Program Year.
- Two Guest Parking Permits may be issued per property or dwelling unit per Program Year.
- Resident and Guest Parking Permits shall be valid for a maximum of a one-year period during the Program Year, and shall be renewed each Program Year. Resident and Guest Parking Permits for the upcoming year may be purchased beginning in October of the current year. The Town will not issue refunds for any unused portion of the Program Year due to non-use or relocation.
- A motor vehicle displaying a valid Resident or Guest Parking Permit, as provided in this Section, shall be permitted to stop, stand, or park, where safe to do so, adjacent to the paved portion of the public right-of-way within the Resident-Only Parking Permit area. Holders of such parking permits shall continue to be subject to all other applicable traffic and parking regulations under the Town Code, including but not limited to, prohibitions on overnight parking, intersection setbacks, fire hydrants, etc. A Resident-Only or Guest Parking Permit shall not guarantee or reserve to the holder a parking space within the Resident-Only Parking Permit area.
The following types of Parking Permits shall be issued by the Town:
- The Resident Parking Permit shall be a decal and shall be affixed only to the motor vehicle for which it was issued. The decal shall be permanently attached to the inside left/driver’s side, lower corner of the rear window, and must be clearly visible from outside the vehicle. Information shown on the permit decal shall include but not be limited to the permit number and the expiration date.
- The Guest Parking Permit shall be a temporary, removable permit designed for use by transient visitors and guests of residents of the Resident-Only Parking Permit area. The Guest Parking Permit shall be of a form and displayed in a manner determined by the Town Manager or designee.
- The following vehicle types shall be exempt from this Schedule:
- Public safety and public service agency vehicles. Public service vehicles shall be limited to governmental and utility vehicles.
- Service Vehicles, including delivery vehicles actively delivering or picking up goods, at a residential property.
- Provisional Parking may be allowed as follows by the Town Police Department to provide extra parking for guests of residents for non-commercial activities and events such as a party, gathering or meeting. Eligibility to request Provisional Parking shall be limited to Residents who have purchased at least one Resident and one Guest Parking Permit. Provisional Parking may be requested up to a maximum of 4 times per residence, per Program Year. The Town Manager or designee may authorize additional Provisional Parking on a case-by-case basis. Provisional Parking shall not guarantee or reserve parking spaces within the Resident-Only Parking Permit area; but shall allow for limited parking in a delineated section of the Residential Only Parking Permit area without a Resident or Guest Parking Permit. Provisional Parking authorization shall be requested of and administered by the Town Police Department, at least two business days before an event, and identify a specific activity or event location, vehicle details and the anticipated duration of the activity or event. In granting such a request, the Police Department may require a display of identification for any vehicles that may be provided Provisional Parking status. The Provisional Parking allowance and arrangements shall be for a reasonable duration and scope as determined by the Town Police Department. Such parking shall be valid only on the day of the activity or event, and may be limited to a specific timeframe.
- The Town Manager shall be authorized to temporarily suspend the Resident-Only Parking Permit area restrictions during special events or circumstances that are deemed to have a public and non-commercial purpose.
- No person shall park a motor vehicle on any restricted public right-of-way within the Resident-Only Parking Permit area unless the motor vehicle displays a valid Resident or Guest Parking Permit or is otherwise allowed via Exceptions as provided by this Schedule.
- No person other than the permittee shall use or display the Resident Parking Permit on a motor vehicle other than that for which the permit is issued, and any such use or display by a person other than the permittee or as allowed via a Guest Permit on a motor vehicle for which the permit is issued shall constitute a violation of this Schedule by the permittee and by the person who so used or displayed such parking permit.
- It shall be a violation of this Schedule for any person to falsely represent oneself as eligible for a Resident or Guest Parking Permit or to furnish any false information in an application in order to obtain a Resident or Guest Parking Permit.
- It shall be a violation of this Schedule for any person to lend or sell the right to use a Resident or Guest Parking Permit, or knowingly permit the use of same, by one not entitled to the use of such permit.
- The Town Manager or designee is authorized to revoke the Resident or Guest Parking Permit of any permittee found to be in violation of this Schedule and, upon written notification thereof, the permittee shall surrender such permit to the Town Manager or designee.
Anyone violating or failing to comply with any of the requirements of this Schedule shall be guilty of violation of this Code, subject to the penalties of Chapter 72 of our Municipal Code listed below.
Chapter 72.11 - Penalty
(A) The provisions of this Chapter shall be applicable to all parking violations within the Town, and the monetary fines payable in each instance are as set forth opposite each listed violation:
- Parking in time restricted area (except parking spaces designated for use by disabled persons), unlawful parking, or parking where parking is prohibited: .....$75.00
- Parking, stopping, or standing a vehicle within any specially designated and marked parking space for use by disabled persons in violation of F.S. § 316.1955: .....$250.00
(B) Any monetary fines imposed for parking violations shall be paid by the owner of the vehicle no later than 14 days from the date of issuance of the parking citation.
(C) Reserved.
(D) In the event the owner of a vehicle fails to pay the applicable parking violation monetary fine within 14 days of issuance of the citation, or otherwise contest the citation as provided for in this Chapter, the Town may assess an additional graduated delinquency fee. To the extent applicable, a delinquency fee will be assessed in accordance with the following schedule:
- payments made between 15 days and 44 days from the date of citation issuance will be assessed an additional amount of .....$75.00;
- payments made between 45 days and 74 days from the date of citation issuance will be assessed an additional amount of .....$150.00; and
- payments made 75 days or more after the date of citation issuance will be assessed an additional amount of .....$225.00.
Notwithstanding the foregoing, the maximum delinquency fee the Town may impose against a vehicle owner shall be .....$225.00.
